VinoMate Terms of Use
Working draft. This document describes what the service actually does today and is published so it can be read rather than promised. It has not been through legal review, and it will be replaced when it has.

These Terms of Use ("Terms") are an agreement between you and Vino2Vino ("Vino2Vino," "we," "us"), the company behind VinoMate. They govern your use of VinoMate — the wine-intelligence connector for AI assistants — together with vinomate.ai, the VinoMate account portal, and the Somm subscription (together, the "Service"). By using the Service, you agree to these Terms and to the Privacy Policy, which explains how we handle your data.
1. What VinoMate is (and isn't)
VinoMate provides wine information and recommendations — ratings context, winery track records, drinking windows, pairing suggestions, value assessments — through AI assistants such as Claude, and through the account portal. It is an informational service. It is not a retailer: you cannot buy wine through VinoMate, and we take no orders and process no alcohol transactions. Recommendations are our data-driven opinions, not guarantees; wine is variable, bottles differ, and some outputs (clearly labeled) are statistical estimates rather than observed facts.
VinoMate runs inside third-party AI assistants. Your use of the assistant itself is governed by that platform's own terms; these Terms govern the VinoMate connector and services we operate.
2. Who may use the Service
You must be of legal drinking age where you live — 21 or older in the United States — to use the Service. Creating an account requires you to attest that you are 21 or older. If you are not of legal drinking age, you may not use the Service, with or without an account.
3. Accounts
You can use VinoMate's core features without an account. An account (via Google sign-in) adds memory: your taste profile, saved wines, cellar, and history. You are responsible for activity under your account and for the security of the Google account you sign in with. You may delete your account at any time from the portal; deletion works as described in the Privacy Policy.
4. Somm (paid subscription)
Somm is an optional paid tier adding proactive features (for example, cellar watching and drink-window alerts). Pricing is shown at purchase. Subscriptions renew automatically each billing period until cancelled; you can cancel any time, effective at the end of the current period. Except where the law requires otherwise, fees are non-refundable for partial periods. We may change Somm pricing with at least 30 days' notice, effective at your next renewal. Taxes may apply.
5. Your content
You may provide content to the Service — cellar imports and exports from other platforms, check-ins, preferences, feedback, photographs of wine lists submitted through your assistant. You retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free license to host, process, and use it to operate and improve the Service, including deriving anonymous, aggregated data (for example, price observations and drinking-pattern signals with all personal identifiers removed) that may be retained after you delete your account, as described in the Privacy Policy. You are responsible for having the right to provide what you provide — import only exports of your own data from other platforms, consistent with their terms.
6. Our content and data — license and restrictions
The Service's databases, scores, drinking windows, editorial synthesis, software, and site content are owned by Vino2Vino or its licensors and are protected by intellectual-property and database-rights laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service and its outputs for personal, non-commercial purposes.
You may not, except with our prior written agreement:
- scrape, crawl, bulk-download, or systematically extract the Service's data, whether directly, through an assistant, or through automation;
- use the Service or its outputs to train, fine-tune, or evaluate machine-learning or AI models, or include them in any dataset used for those purposes;
- resell, sublicense, or commercially redistribute the Service's data or outputs, or build a competing database or service from them;
- circumvent rate limits, access controls, or technical protections, or probe or disrupt the Service;
- misrepresent outputs as your own data or remove attributions.
Personal sharing is fine — quoting a recommendation to a friend, posting a screenshot, citing a fact from our blog with attribution is use we welcome. Businesses interested in our data should ask about CellarGraph at vino2vino.com.
7. Acceptable use
You agree not to use the Service to violate any law (including alcohol-beverage laws applicable to you), infringe others' rights, submit content you have no right to submit, or attempt to identify individuals from any pseudonymous data the Service exposes. We may set and enforce rate limits designed for human conversational use.
8. Drink responsibly
VinoMate helps you choose wine well — never to drink more. Nothing in the Service is a recommendation to consume alcohol. Do not drink and drive. Alcohol has health risks; if you have questions about alcohol and your health, consult a medical professional. Nothing in the Service is medical advice.
9. Affiliate links and independence
Recommendations and rankings are never paid placements. Where we include affiliate links (for example, in our emails or blog), they are attached after selection is made on merit, and disclosed. A retailer paying us a commission never affects whether or how a wine is recommended.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THAT: drinking windows, vintage assessments, and similar outputs are estimates derived from data and models; prices and availability change; and we do not warrant that any wine will match its description or your taste. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VINO2VINO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (B) FIFTY U.S. DOLLARS ($50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Disputes; governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Nevada County, California, and both parties consent to their jurisdiction — except that either party may bring an eligible claim in small-claims court.
13. Termination
You may stop using the Service, or delete your account, at any time. We may suspend or terminate access (including anonymous access) for violation of these Terms, abusive load, or legal necessity — and where practical for account holders, we will say why. Sections that by their nature survive (5–6, 10–12) survive termination.
14. Changes to the Service and these Terms
The Service will evolve; features may change, and free features may move between tiers prospectively (our stated principle: answer quality is never degraded by tier). We may update these Terms; if a change is material, we will give account holders advance notice by email or through the Service. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and, if applicable, cancel your subscription before renewal.
15. General
These Terms plus the Privacy Policy are the entire agreement between you and Vino2Vino regarding the Service. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, with notice.
